By accessing secondhousearchive.com, attending a Second House Archive popup, submitting an application, purchasing an item, or consigning with us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the site or services.

Second House Archive is a curated reselling popup based in New York City. All items offered are pre-owned goods consigned to us by third parties. We are not affiliated with, endorsed by, or sponsored by any of the brands whose items may appear at our popups.

You must be at least 18 years old to consign, purchase, or submit an application. By using the site or services you represent that you meet this requirement and that the information you provide is accurate.

Individuals who consign items ("Consignors") agree that all items submitted are legally owned by the Consignor, are authentic, and are free of any liens or claims. Consignment is governed by a separate Consignment Agreement signed at intake, which controls in the event of any conflict with these Terms.

All sales at Second House Archive are final sale. No returns, exchanges, refunds, or credits are offered except as expressly stated in our Return Policy. Items are pre-owned and sold in as-is condition. Prices, availability, and event details are subject to change without notice.

Product names, brand names, trademarks, and logos referenced or displayed on the site or at popups are the property of their respective owners. Their appearance does not indicate any affiliation, sponsorship, or endorsement by those brand owners.

When you submit an application, photos, testimonials, or other content to us, you grant Second House Archive a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with operating and marketing our business. You represent that you have the right to grant this license.

The site, including its design, text, graphics, logo, and other content, is owned by Second House Archive and protected by intellectual property laws. You may not copy, reproduce, or exploit any portion of the site without our prior written consent.

You agree not to misuse the site or services, including attempting to interfere with security, submitting false information, infringing on the rights of others, or using the site for unlawful purposes.

The site and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

To the maximum extent permitted by law, Second House Archive and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the site or services. Our aggregate liability for any claim relating to a purchase will not exceed the amount you paid for the item at issue.

You agree to indemnify and hold harmless Second House Archive from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the site or services.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the services will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.

We may update these Terms from time to time. Continued use of the site or services after changes are posted constitutes acceptance of the updated Terms.

By submitting the RSVP / Guest Key form you consent to receive emails and messages from Second House Archive about Drop 01 and future events; you may unsubscribe at any time. Information you provide (name, email, and optional interests) is used to run our events, communicate with you, and administer promotions, and is never sold. RSVP does not guarantee entry; admission, capacity, and perks may change without notice. Any giveaway or promotion is open to legal residents of the United States aged 18 or older, is void where prohibited, requires no purchase, and winners are selected at our discretion and may be asked to verify eligibility. Giveaways are in no way sponsored, endorsed, or administered by Instagram, TikTok, or any other social platform, and entrants release those platforms from any liability. By entering you permit us to use a winner's first name and city for announcements.
